You assume full responsibility for ensuring that you have the proper authorization to act on behalf of the company in using our Service.

3. Service Description

Our Service provides an automated candidate filtering process for job recruitment. It should be taken and used as a recommendation system, and it is still the recruiter's decision which candidates to continue the hiring process or interviews with. We reserve the right to make changes or updates to the functionality of our Service in the future.

4. Payment Terms

4.1 Paid Services: Our Service is offered on a paid basis. Users may purchase credits or subscribe to recurring payment plans to access and use the Service. Payment details and pricing options are available on our platform and may change from time to time.

4.2 No Refunds: All payments made for credits or subscriptions are final. We do not offer refunds for any reason, including but not limited to unused credits, account deletion, technical issues, or dissatisfaction with the Service.

4.3 Subscriptions: Recurring subscriptions will automatically renew at the end of each billing cycle unless canceled. It is the user's responsibility to cancel subscriptions if they no longer wish to use the Service.

5. Service Use and Limitations

5.1 Service Access: While we strive to ensure that our Service is available at all times, we do not guarantee uninterrupted or error-free access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

5.2 Accuracy of Analysis: Our Service utilizes various AI models and algorithms to generate candidate analyses and summaries. These analyses and summaries may not always be accurate, complete, or aligned with the original resume or job description content. We do not provide any warranties regarding the quality, accuracy, or reliability of the analyses or summaries.

5.3 Decision-Making Responsibility: The Service is designed to assist in the initial filtering process of job applications. It is not intended to replace human decision-making in the hiring process. Users are solely responsible for their hiring decisions and should not rely exclusively on the Service's output.

5.4 Prohibited Uses: Analyses and summaries generated by our Service are intended for internal use only within your organization's hiring process. You are not permitted to sell, distribute, or otherwise use the analyses or summaries for any other commercial purposes without explicit written permission from us.

5.5 Technical Issues: We may encounter technical difficulties that could prevent the successful analysis of resumes or job descriptions. We do not guarantee that all documents can be processed and do not offer refunds for credits used in unsuccessful attempts.

5.6 Content Removal: We reserve the right to remove or delete any previously generated analyses or summaries from our database, particularly in the case of technical issues or maintenance. Users are not entitled to a refund for any credits associated with deleted content.

6. Intellectual Property

6.1 Ownership: All intellectual property rights in our Service, including but not limited to software, design, content, and analyses, are owned by Loheden AI Solutions AB or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for your organization's internal hiring purposes only.

6.2 Restrictions: You are prohibited from copying, modifying, distributing, selling, or leasing any part of our Service or the analyses generated, as well as from reverse engineering or attempting to extract the source code of our software, except as permitted by law or with our explicit written consent.

7. Account Deletion and Termination

7.1 User-Initiated Deletion: You may delete your account at any time through your account settings or by contacting us for assistance. Upon deletion, all associated data will be permanently removed, and you will not be entitled to a refund for any unused credits or subscription fees.

7.2 Termination by Us: We reserve the right to suspend or terminate your account if we suspect any violation of these Terms, fraudulent activity, or any other misuse of the Service. In such cases, you will not be entitled to a refund of any unused credits or subscription fees.

8. Limitation of Liability and User Responsibility

8.1 Disclaimer of Warranties: Our Service is provided "as is" and "as available" without any warranties, express or implied. We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 Limitation of Liability: To the fullest extent permitted by law, Loheden AI Solutions AB shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service, including but not limited to incorrect hiring decisions, loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.

8.3 User Responsibility and Risk: You acknowledge and agree that you use our Service at your own risk. Loheden AI Solutions AB shall not be held responsible for any potential damages, losses, or liabilities that may arise directly or indirectly from your use of the Service, including any decisions made based on the Service's output. You are solely responsible for any consequences resulting from your use of the Service and the hiring decisions you make.

8.4 Indemnification: You agree to indemnify, defend, and hold harmless Loheden AI Solutions AB, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

9. Privacy and Data Protection

9.1 Data Processing: By using our Service, you acknowledge and agree that we will process the job descriptions and resumes you upload in order to provide the Service. You are responsible for ensuring that you have the necessary rights and permissions to upload and process this information.

9.2 Data Retention: We will retain the uploaded documents and generated analyses for as long as necessary to provide the Service and allow you to access your historical data. You may request the deletion of specific data at any time through your account settings.

9.3 Compliance with Laws: You agree to comply with all applicable data protection and privacy laws when using our Service, including obtaining any necessary consents from job applicants for the processing of their personal data.

10. Governing Law and Dispute Resolution

10.1 Governing Law: These Terms and your use of the Service are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles.

10.2 Dispute Resolution: Any disputes arising out of or relating to these Terms or the Service will be resolved exclusively by the competent courts in Sweden. The decision of these courts shall be final and binding on all parties involved.

11. Changes to Terms

11.1 Modification of Terms: We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service following any changes to these Terms constitutes your acceptance of the revised Terms.

12. Miscellaneous
